Authority Provision
Part 1 CHAPTER II. NEW RIGHTS AND GUARANTEES Article 41

"All inhabitants enjoy the right to a healthful, balanced environment fit for human development, so that productive activities satisfy current needs without compromising those of future generations, and have the duty to preserve the environment. Environmental damage shall generate as a priority the obligation to repair it under the terms that the law shall establish.
The authorities shall provide for the protection of this right, for the rational use of natural resources, for the preservation of the natural and cultural patrimony and of biological diversity, and for information and education on the environment...."

CHAPTER I. THE STATE AND THE CONSTITUTION Section 9: 9. PROTECTION FROM DEPRIVATION OF PROPERTY 4, a, v.

The Constitution "makes provision for the taking of possession or aquisition of any property, interest, or right - v. in circumstances where it is reasonably necessary so to do because the property is in a dangerous state or likely to be injurious to the health of human beings, animals or plants"

18A. PROTECTION AND IMPROVEMENT OF ENVIRONMENT AND BIODIVERSITY

"The State shall endeavour to protect and improve the environment and to preserve and safeguard the natural resources, bio-diversity, wetlands, forests and wild life for the present and future citizens."

"27. PROTECTION FROM DEPRIVATION OF PROPERTY.
2(f,h)"

2. Nothing in this Article shall be construed as affecting the making or operation of any law so far as it provides for the taking of possession or acquisition of property- f) "where the property consist of an animal upon its being found trespassing or straying" or (h) "by reason of its being in a dilapidated or dangerous state of injurious to the health of human being, animals or plants"

25. PROTECTION OF FREEDOM OF MOVEMENT (a,i.)

2. Nothing contained in or done under the authority of any law shall be held to be inconsistent with or in contravention of this Article to the extent that the law in question makes provision- a.which is reasonably required-(i).in the interests of ...the prevention of plant or animal diseases

2. Nothing contained in or done under the authority of any law shall be held to be inconsistent with or in contravention of this section- (a) to the extent that the law in question makes provision for the taking of possession or acquisition of any property- (v) v.in circumstances where it is reasonably necessary so to do because the property is in a dangerous state or injurious to the health of human beings, animals or plants...
